Welcome to Infosky Mart! These Terms of Use (“Terms”, “Agreement”) govern your access to and use of the Infosky Mart website, mobile application(s), and related services (collectively, the “Platform”), operated by Infosky Mart (“Company”, “we”, “us”, or “our”).

By accessing, browsing, or using our Platform, creating an account, or placing an order, you agree to be bound by these Terms and our [Privacy Policy]. If you do not agree to all of these Terms, you must immediately discontinue use of the Platform.

1. Eligibility & Account Registration

4. Account Termination: We reserve the right to suspend or terminate accounts, refuse service, or cancel orders at our sole discretion if we suspect fraudulent, unauthorized, or illegal activity.

2. Products, Pricing & Availability

1. Product Descriptions: We attempt to display the descriptions, images, and colors of our products as accurately as possible. However, we do not warrant that product descriptions, colors, or other content on the Platform are complete, accurate, reliable, or error-free.
2. Pricing: All prices displayed on the Platform are subject to change without prior notice. Prices are inclusive/exclusive of applicable taxes and shipping fees as indicated during checkout.
3. Errors & Omissions: In the event that a product is listed at an incorrect price or with incorrect information due to a typographical error or technical glitch, Infosky Mart reserves the right to cancel or refuse any orders placed for that product, whether or not the order has been confirmed or your payment processed. If your payment has already been processed, we will issue a full refund.
4. Stock Availability: Product availability is subject to change. We reserve the right to limit the order quantity of any product or discontinue products at any time without prior notice.

3. Orders, Payments & Billing

1. Order Acceptance: Placing an order constitutes an offer to purchase. An order is only accepted once you receive an official order confirmation from us via email, SMS, or app notification.
2. Payment Methods: We accept various payment methods, including credit/debit cards, net banking, digital wallets, UPI, and Cash on Delivery (COD) (where applicable). By submitting payment details, you represent that you are authorized to use the chosen payment method.
3. Payment Security: Payments are processed securely via third-party payment gateways. Infosky Mart does not store your full card details or sensitive payment credentials on its servers.

4. Shipping, Delivery & Risk of Loss

1. Delivery Timelines: Estimated shipping and delivery dates are provided for convenience only and are not guaranteed. Infosky Mart is not liable for delivery delays caused by shipping carriers, customs checks, weather conditions, or events beyond reasonable control.
2. Title & Risk of Loss: All items purchased from Infosky Mart are made pursuant to a shipment contract. The risk of loss and title for items pass to you upon our delivery of the item to the carrier.

5. Cancellation, Returns & Refunds

1. Order Cancellation: You may request to cancel an order before it has been processed or dispatched. Once an order has been shipped, it cannot be canceled and must follow our Return Process.
2. Return & Refund Policy: Returns, replacements, and refunds are governed by our dedicated [Return and Refund Policy]. Products must be returned in their original condition, unused, with all tags and original packaging intact, within the stipulated return window.

6. Prohibited Activities

When using the Platform, you agree NOT to:

• Violate any applicable local, national, or international laws or regulations.

• Upload or transmit viruses, malware, trojan horses, or any malicious code.
• Attempt to gain unauthorized access to our servers, networks, or user databases.
• Scrape, reverse-engineer, frame, or use automated systems (bots, crawlers) to extract data from the Platform without prior written consent.
• Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
• Post false, misleading, defamatory, offensive, or inappropriate product reviews or content.

7. Intellectual Property Rights

1. Ownership: All content on the Platform—including logos, trademarks, text, graphics, product designs, software, UI elements, audio, and video—is the exclusive property of Infosky Mart or its content suppliers and is protected by copyright, trademark, and intellectual property laws.
2. Limited License: You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform for personal, non-commercial shopping purposes only. You may not reproduce, distribute, modify, create derivative works from, or exploit any content without express written consent from Infosky Mart.

8. User Content & Reviews

1. Submissions: If you submit reviews, comments, feedback, or suggestions on the Platform (“User Content”), you grant Infosky Mart a non-exclusive, royalty-free, perpetual, worldwide right to use, reproduce, modify, publish, and display such content in any media.
2. Content Guidelines: You warrant that your User Content does not violate third-party rights (copyrights, trademarks, privacy) and is not unlawful, obscene, or defamatory. We reserve the right to remove or edit any User Content at our discretion.

9. Third-Party Links & Services

The Platform may contain links to third-party websites, services, or payment processors that are not owned or controlled by Infosky Mart. We assume no responsibility for the content, privacy policies, or practices of any third-party sites. Your interactions with third parties are solely between you and the third party.

10. Limitation of Liability & Disclaimers

1. “As Is” Basis: The Platform and all products and services offered through it are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied.
2. Disclaimer of Warranties: To the fullest extent permitted by law, Infosky Mart disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
3. Limitation of Liability: In no event shall Infosky Mart, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform or products purchased, even if advised of the possibility of such damages. Our total cumulative liability to you shall not exceed the total amount paid by you for the product or order giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Infosky Mart, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, expenses, or costs (including reasonable legal fees) arising from:

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India/Haryana, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms or the Platform shall be instituted exclusively in the courts located in Gurgaon.
