2. Product Information & Availability

Product Listings: We make every effort to display product descriptions, specifications, pricing, stock availability, and colors as accurately as possible. However, we do not warrant that product descriptions or other content are entirely accurate, complete, current, or error-free.
Color Variations: Actual product colors may vary depending on your monitor settings, screen resolution, or device capabilities.
Inventory & Quantities: All products are subject to availability. We reserve the right to limit the sales of our products to any person, geographic region, or jurisdiction, and to limit order quantities per person, household, or order.

3. Pricing, Payments & Invoicing

Pricing Policy: Prices for products listed on Infosky Mart are subject to change without prior notice. Unless stated otherwise, prices are displayed in the applicable local currency and are exclusive or inclusive of statutory taxes (e.g., GST/VAT) as specified during checkout.
Pricing Errors: In the event that a product is listed at an incorrect price due to a typographical, system, or vendor error, Infosky Mart retains the right to cancel or refuse any orders placed for the incorrectly priced item, even if the order has been confirmed or your account charged. If your payment was processed prior to cancellation, a full refund will be issued to your original payment method.
Payment Gateways: Payments are processed securely via PCI-DSS compliant third-party payment gateways. We accept credit/debit cards, net banking, digital wallets, UPI, and Cash on Delivery (COD) (where available). You warrant that you have lawful authority to use any payment instrument provided.

4. Orders & Order Acceptance

Order Confirmation: Receiving an electronic order acknowledgement or receipt does not constitute our acceptance of your order. An order is deemed accepted only when you receive an explicit dispatch/shipment confirmation email or app notification.
Order Cancellations by Us: We reserve the right to reject or cancel any order for reasons including, but not limited to:
- Product unavailability or stock-outs.
- Unverified or incomplete payment or address details.
- Suspected fraudulent, suspicious, or illegal transactions.
- Breach of purchase volume limits.
Order Cancellations by User: You may request to cancel an order before it enters the processing/shipping stage via your account dashboard or customer support. Once shipped, cancellations are no longer permitted, and the order must be processed through our Return Policy.

5. Shipping & Delivery

Delivery Services: Shipping and handling services are fulfilled via third-party logistics partners. Estimated delivery timelines provided during checkout are approximate estimates and not guaranteed delivery dates.
Shipping Charges: Shipping fees and handling costs are calculated at checkout based on delivery location, package weight, and order value.
Risk of Loss: Title and risk of loss for all items pass to you upon delivery of the items to the designated carrier or upon physical delivery to your specified address.
Delivery Delays: Infosky Mart is not liable for delivery delays caused by events beyond our reasonable control, including extreme weather conditions, customs procedures, strikes, natural disasters, or transportation interruptions.

6. Returns, Refunds & Replacements

Scrape, data-mine, crawl, frame, or harvest data or product details from the Platform using automated software without express written permission.
Attempt to bypass or circumvent any security controls, authentication mechanisms, or rate limits.
Impersonate any individual, business entity, or representative of Infosky Mart.
Post defamatory, abusive, offensive, obscene, or unlawful reviews, feedback, or content.

8. Intellectual Property Rights

Ownership: All content on the Platform—including trademarks, logos, brand names, service marks, graphics, user interfaces, text, images, product photos, software code, and sound files—is the exclusive property of Infosky Mart or its licensors and is protected by copyright, trademark, and intellectual property laws.
Limited Access License: You are granted a personal, revocable, non-exclusive, non-transferable license to access and use the Platform for shopping and personal reference only. No portion of the Platform may be reproduced, modified, distributed, resold, or exploited for commercial purposes without our explicit written consent.

9. User Content & Product Reviews

Feedback & Reviews: If you submit product reviews, comments, ratings, or suggestions (“User Content”), you grant Infosky Mart a perpetual, worldwide, royalty-free, non-exclusive right to edit, reproduce, publish, translate, and distribute such content in any media.
Content Standards: You represent that your User Content does not infringe upon third-party intellectual property, privacy, or publicity rights, and does not contain illegal or harmful material. We reserve the right to remove or decline to post any review at our sole discretion.

10. Third-Party Links & Services

Our Platform may contain links to external third-party websites, services, or embedded resources. Infosky Mart does not control, endorse, or assume responsibility for the content, privacy practices, or safety of any third-party websites or services. Your interactions with third parties are solely at your own risk.

11. Disclaimer of Warranties

“As Is” Basis: The Platform, its services, and all products made available through it are provided on an “AS IS” and “AS AVAILABLE” basis without any representations or warranties of any kind, whether express or implied.
No Guarantee: Infosky Mart does not guarantee that the Platform will be uninterrupted, error-free, completely secure, or free from server glitches or downtime.

12. Limitation of Liability

To the fullest extent permitted by law, Infosky Mart, its directors, officers, employees, affiliates, and suppliers shall not be liable for any indirect, incidental, punitive, special, or consequential damages (including loss of profits, loss of data, business interruption, or loss of goodwill) arising out of or in connection with:

Your use of or inability to use the Platform;
Any products purchased through the Platform;
Unauthorized access to or alteration of your personal account data.

Our total cumulative financial liability to you for any claim arising out of these Terms shall not exceed the actual amount paid by you for the specific product or order giving rise to the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless Infosky Mart, its affiliates, officers, directors, agents, contractors, and employees from and against any claims, liabilities, damages, judgments, losses, expenses, or costs (including reasonable legal fees) resulting from your breach of these Terms, your violation of any law, or your violation of third-party rights.

14. Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of India/Haryana, without giving effect to any principles of conflicts of law. Any legal proceedings or disputes shall be submitted exclusively to the competent courts located in Gurgaon.

15. Changes to Terms & Conditions

We reserve the right to update, modify, or replace any part of these Terms and Conditions at any time. When updates occur, we will revise the “Last Updated” date at the top of this document. Continued use of or access to the Platform following the posting of any changes constitutes acceptance of those updates.
